Georgia Superior Court Senior Judge David Sweat dismissed the writ of mandamus against the Oglethorpe County Board of Commissioners on July 10.
The writ was filed by Arnoldsville resident Fern Williams on May 17 to compel the county to fund and construct a dog impoundment facility, among other things.
The writ also stated that BOC Chairman Jay Paul and the BOC “provide for the implementation of procedures and reports required by (county ordinances relating to animals); hire an animal control officer to enforce such ordinances; and to fund and provide adequate vehicle and other equipment for the animal control officer to carry out his duties.”
Sweat heard arguments on July 1.
“The court determines that, even considering all allegations of petitioner’s complaint to be true, there is no basis upon which the court could grant the mandamus relief sought,” the decision states. “Petitioner fails to identify any legal basis which would provide the court authority to issue the writ of mandamus and order relief.”
