The Oglethorpe Echo
Legal action is being taken against the Oglethorpe County Board of Commissioners over the enforcement of dog ordinances.
Fern Williams filed a writ of mandamus as a civil proceeding in the county’s Superior Court on May 17. According to Georgia Code 9-6-20, this writ is used to “compel public officials to perform their official duties where there is no other adequate legal remedy.”
The writ has been filed against the chairman and each member of the BOC. It has been assigned to Judge Harvey S. Wasserman.
In 2021, the Oglethorpe County Board of Commissioners approved an ordinance concerning nuisance animals, as previously reported in The Echo.
The ordinance states any animal that attacks a person, their property or their animals is a nuisance animal, and its owner is in violation of county law.
The current process for a dog that attacks a person, property or pet is for it to be impounded, as reported in The Echo last month.
